Delhi High Court orders removal of content violating Janhvi Kapoors personality rights

Actor Janhvi Kapoor has approached the Delhi High Court to protect her personality rights in the age of deepfakes and AI-enabled misuse of celebrity images and likeness. She filed the plea after discovering “pornographic and obscene content” using her name and image online. Her case also targets widespread social media impersonation and AI-generated deepfakes. The court has ordered the immediate removal of the offensive material.

Remove Deepfakes, protect genuine fan pages

At this point, the Delhi High Court is actively considering whether a ban on all fan pages can be sanctioned. That’s because, according to the court, legitimate fan pages needn’t be shut down entirely. Fan accounts often express admiration and share routine updates about celebrities, the court noted. The court emphasised that personality rights must be balanced with freedom of speech and expression. Protecting a celebrity’s image cannot result in suppressing genuine fan engagement or public discourse. Blocking fan pages outright would set a concerning precedent for online speech.

The court directed social media platforms and websites to take down deepfakes, sexually explicit material and unauthorised pornographic imagery featuring the actor. However, non-infringing fan pages and meme accounts that do not upload obscene material will remain operational.

As per media reports, Meta’s representative argued against verifying thousands of disputed web links on the platform, saying that it would be “impossible” to do so. It remains to be seen what Janhvi Kapoor’s representative will say during the next hearing.
