
The case centered on a 2.70 acres land parcel in Sholinganallur, Chennai. The plaintiffs claimed to be the legal heirs of late MC Chandrasekaran and sought partition rights over the property. They also contested the sale deeds executed in favour of Sridevi, her mother and sister in 1988, alleging that the sellers did not possess a valid title to the land.
The plaintiffs claimed that the land originally belonged to MC Sambanda Mudaliar. He purchased larger areas of the land in 1943. The plaintiffs also claimed that they discovered the alleged fraud only in 2023, after a patta was issued in the names of Boney Kapoor, Janhvi Kapoor and Khushi Kapoor.
Boney Kapoor and his daughters approached the High Court seeking dismissal of the plaint under Order VII Rule 11 of the Code of Civil Procedure.
The Kapoors contended that the plaintiffs were not Class I legal heirs of MC Chandrasekaran. They further argued that Chandrasekaran had never disputed the 1988 sale deeds during his lifetime. Although Chandrasekaran died in 1995, the suit came to be filed only in 2025.
The court eventually agreed with Boney Kapoor’s claims and observed that the suit was filed forty years after the sale deeds were executed. This made the suit barred by limitation.
